Learned counsel for the petitioners/Bank submits that no application under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 is pending at the behest of the borrower. However, the petitioners' application under Section 14 of the 2002 Act has been kept pending beyond the statutory period.

There being substance in such contention, W.P.A. No. 3657 of 2023 is allowed, thereby directing the respondent no. 2, that is, the District Magistrate, North 24-Parganas at Barasat, to dispose of the pending application under Section

14 of the 2002 Act of the petitioners/Bank as expeditiously as possible, positively within November 24, 2023.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
