The petitioner is the physically challenged son of a deceased Assistant Teacher of the Samarpur Bishnupriya Balika Vidyalaya, District- Purba Medinipur. The mother of the petitioner who was receiving family pension on death of the father has also died.

The petitioner in terms of the Memo of the Government of West Bengal, School Education Department, Budget Branch bearing no. 325SE(B)/IM-43/2003 dated September 05, 2005, is praying family pension.

The representation of the petitioner to the said effect being annexure-'P-5' of the writ petition is pending consideration before the District Inspector of Schools (S.E), Purba Medinipur, the respondent no. 3 herein.

Mr. Safik Dewan, learned Counsel for the State files an instruction which he has received

from the said respondent no.3, let it be kept with the record.

It appears from the said instruction that the said respondent is in want of necessary papers to consider the prayer of the petitioner.

The petitioner is directed to submit the wanting papers before the respondent no.3, who thereafter shall consider the said representation of petitioner in accordance with law within a period of four weeks from the date of communication of this order.

W.P.A. 3751 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
