The writ petitioner applied to the post of RPF Constable (Ancillary) under Railway Protection Force. After scrutiny the petitioner was found to be otherwise eligible and empanelled. However, in course of medical examination the petitioner's case was rejected for nonsubmission a fitness certificate from the Opthemology. The petitioner had himself examined before the Medical Officer, C. O. M. and JNM Hospital, Kalyani, Nadia and has obtained certificate dated 17.03.2020. The same was not received by the Railways.

In those circumstances, since the said certificate has been filed along with supplementary affidavit and is also available at page 54 to the writ petition, the respondents may consider the same and pass suitable orders on the appointment of the petitioner to the said post in accordance with law within two months from the date of communication of a copy of this order.

Any order that may be passed by the respondents may be communicated to the petitioner within seven days thereof.

With the aforesaid directions, the instant writ petition is disposed of.

No order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
