And In Re : Monoranjan Das @ Manaranjan @ Disco ..... petitioner Mr. Subodh Banerjee ... for the petitioner Mr. Rudradipta Nandy, learned APP Mrs. Sonali Das ... for the State Learned Counsel for the petitioner submits his client is visually disabled. He has been falsely implicated. He prays for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Disability certificate pertains to 2016. There is nothing to show that the disability is still continuing. There are materials collected during investigation show recovery of narcotics above commercial quantity i.e. 97 kgs. of ganja from the possession of the petitioner and co-accuseds. In view of the materials on record and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
