The learned Advocate for the petitioners says that there is nothing in the FIR or in the charge sheet which would justify further custodial detention of the petitioners. They are in custody for about 278 days. They should be enlarged on bail. They will not influence the witnesses in any manner.

The bail prayer of the petitioners was rejected on merits after discussing their possible complicity in the alleged offence on July 16, 2024 in CRM (NDPS) 1054 of 2024.

Since there has been no significant change in circumstances, we see no reason to re-consider their prayer for bail.

We are told by learned Advocate for the State that the trial has begun. One prosecution witness being the independent seizure witness has already been examined in full. He fully corroborates
the prosecution case. The prosecution proposes to examine only 8 out of 20 charge sheet named witnesses.

Therefore, we see that the trial is also likely to conclude within a reasonable period of time.

In view of the aforesaid and prima facie involvement of the petitioners in the alleged crime, we are not inclined to enlarge the petitioners on bail, at this stage.

CRM (NDPS) 232 of 2025 is, thus, dismissed.
