1. Receipt showing payment of deficit court fees filed in Court be taken on record. Affidavit of service also be taken on record.

As many as twenty-eight petitioners in this writ petition are retired volunteers of the National Volunteer Force. They have received the ex gratia amount on their demobilization at a delayed point of time. The petitioners seek interest on account of such delayed payment of ex gratia.

Reliance has been placed on several orders passed by this Court in similar matters. One of such orders annexed to the writ petition is dated August 18, 2025 in WPA No.13903 of 2025 (Sk.

Anwar Ali & Ors. v. The State of West Bengal & Anr.) wherein the Court directed grant of interest on account of such delayed payment.

In line with the aforesaid order, the instant writ petition stands disposed of by directing the respondent nos.2 and 3 - The State Commandant, West Bengal, Bengal National

Volunteer Force Directorate, Kalyani and the Inspector General of Police & The State Commandant, West Bengal National Volunteer Force Directorate, Kalyani - to pay simple interest on account of delayed payment of the one-time ex gratia to the petitioners at the rate of 6% p.a. from the next date of demobilization till the date of actual payment, within a period of twelve weeks from the date of communication of this order. 5.

In default, 3% additional simple interest i.e. 6% +3%=9% p.a. shall be payable to the petitioners. 6.

Since the writ petition is disposed of without calling for affidavits, the allegations contained in the writ petition are deemed not to have been admitted by the respondents.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
