As the appellant does not want to proceed with the appeal, the appellant may be permitted to withdraw the appeal. Accordingly, the appeal is dismissed as withdrawn. In view of the above, the applications, being IA No. CAN 1 of 2012 (Old No. CAN 2490 of 2012) and IA No. CAN 2 of 2012 (Old No. CAN 2491 of 2012) also stand disposed of.

The appellant is permitted to withdraw the statutory deposit of Rs. 25,000/- with accrued interest, if any.
