The learned Mediator has recorded in the report that the meeting was "concluded with the execution of a terms of settlement". It is jointly submitted by learned counsel for the parties that these terms of settlement have effectively put an end to their dispute. Furthermore, they propose to file these terms before the learned 2nd Civil Judge, Junior Division at Alipore in Title Suit no. 1019 of 2017 and before the 5th

Civil Judge, Senior Division at Alipore in Title Suit no. 1206 of 2017.

In view of such submission, the appeal and the connected application are dismissed as withdrawn. With regard to the terms, the steps to be taken mentioned in Clause a) therein, shall be taken within the next 30 days from this order instead of next 30 days from the date of execution of the terms as mentioned therein, which period has long elapsed.

The department is directed to issue a certified copy of this order. The terms and settlement may be separately furnished to the parties on proper requisition.
