Re: CAN 1 of 2021 With CAN 2 of 2021 Mr. Shankar Ranjan Sen, Standing Counsel for the Eastern Railway, is present in Court and has accepted the applications being CAN 1 of 2021 and CAN 2 of 2021 on behalf of the Railways.

In view of the fact that the writ petitioner No.1 died during the pendency of the writ petition and the writ petitioner No.2, son of the writ petitioner No.1, in whose favour the mother, the writ petitioner No.1 herein, had applied for compassionate appointment, there is no necessity for substitution and only the death of the writ petitioner No.1 is to be noted.

Learned Counsel appearing for the writ petitioners is directed to delete the name of the writ petitioner No.1 from the cause title of the instant writ petition. The applications being CAN 1 of 2021 and CAN 2 of 2021 are disposed of in terms of the aforesaid order. Re: WPCT 19 of 2021 In view of the changed facts and circumstances, namely, the death of the writ petitioner No.1, liberty is given to the sole petitioner, namely, Surojit Dutta, to make a representation for compassionate appointment within two weeks from date.

In the event such an application is made, the Railway authorities shall consider and dispose of the said application in accordance with law within a period of six weeks from the date of such representation by a reasoned order which shall be communicated to Surojit Dutta within one week thereafter. With the aforesaid observation, the writ petition being WPCT 19 of 2021, accordingly, stands disposed of.
