1. Petitioners are not the principal offender. They are in custody for five months. They pray for bail.

2. Learned lawyer for the State opposes the bail prayer.

3. We have considered the materials on record including the statement of one Ajoy Kumar Shau recorded under section 164 Cr.P.C. He states that the petitioners assisted to throttle the victim. As a result he succumbed to his injuries.

4. The aforesaid incriminating materials implicate the petitioner in the murder. Hence we are not inclined to grant bail to the petitioners at this stage.
