Court no.34 19.03.2021 CRR 371 of 2018 Item no.03 (Suvendu) In the matter of: - Munilal Ram ...petitioner The present revisional application initially appeared on 30th April, 2018 when an adjournment was granted. Thereafter, the matter appeared on 16th May, 2018 when none appeared on behalf of the petitioner and the matter was directed to appear in the Monthly List of June, 2018. Lastly, the matter appeared on 30th July, 2018 when an accommodation was sought for on behalf of the petitioner to file a supplementary affidavit. The matter has been running in the list for a considerable period of time and today also, none appears on behalf of the petitioner or prays for any accommodation on its behalf. As such, the matter is taken up for deciding on merits. The revisional application has been preferred challenging an order dated 6th January, 2018 passed by the learned Additional Sessions Judge, Durgapur in Criminal Misc. Case no. 50A of 2017, wherein the learned Court was pleased to refuse the petitioner's prayer for canceling the bail granted by the learned District Judge, Burdwan.
I have perused the impugned order passed by the learned Additional Sessions Judge, Durgapur. Although I find that some of the points so decided by the said Court requires consideration but having regard to the fact that the said order was passed more than three years ago and subsequent conduct of the opposite parties, whose bail were sought to be cancelled, are not before this Court, I do not think it would be fit and proper at this belated stage to interfere with the impugned order.
Accordingly, the revisional application is dismissed.
