The petitioner is aggrieved by the Durgapur Police for not taking steps to investigate into FIR No. 126 of 2023 dated 26th February, 2023. It is also prayed that the police should assist her in entering into her property. The petitioner complains that the private respondent has forged certain documents to demonstrate that the property was gifted by her late mother to the private respondent. The private respondent asserts the gift deed. While the petitioner claims that the private respondent assaulted her, the private respondent claims likewise.

The private respondents have filed a complaint under Section 156 (3) of the Cr. P. C. which is pending. Durgapur Police Station shall complete the investigation into the subject FIR dated 26th February, 2023 within a period of three months mandatorily and positively. Durgapur Police Station shall also ensure that peace is maintained in the area.

Since this Court has not called for affidavits, the allegations made in the writ petition, are deemed not to be admitted by the respondents.

WPA No. 3679 of 2023 stands disposed.
