Leave is granted to the learned counsel for the petitioners to correct the name of the respondent no. 12 by amending the cause title of the writ petition. The petitioners are alleging illegal encroachment on the Government Land.

The earlier writ petition filed by the petitioners being WP No. 17240 (W) of 2019 was disposed of vide order dated September 12, 2019 by requesting the State authorities to complete the proceeding under Section 10(1) of the State Highways Act, 1964 initiated for removal of the said encroachment expeditiously.

The petitioners in the instant writ petition is praying a further direction for disposal of the said proceeding. On perusal of the records it appears that the authorities are taking appropriate steps for removal of the alleged encroachment on the Government Land, as such, at this stage further direction as prayed for is not warranted.

However, it is expected that the authorities shall conclude the said proceeding within a reasonable time.

WPA 4354 of 2021 is thus disposed of. No order as to costs.

Since no affidavit-in-opposition has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
