Mr. Prantick Ghosh Mr. Siddhartha Sarkar ... for the petitioner Mr. Susovan Sengupta, Mr. Subir Pal ... for the State The petitioner is aggrieved by the inaction on the part of the second appellate authority to dispose of the appeal preferred by him under Clause 32 of the West Bengal Public Distribution System (Maintenance and Control Order), 2013.

It appears that the Joint Secretary, by a communicating Memo dated 21st September, 2021 requested the petitioner to appear for a hearing on 3rd November, 2021. The petitioner asserts that he was present at the time of hearing and he made submissions in his support along with supporting documents.

The petitioner alleges that the fate of the appeal is yet to be made known to him.

As it appears that the hearing was conducted on 3rd November, 2021 it is incumbent on the part of the second appellate authority being the Secretary,

Department of Food and Supplies to take a decision with regard to the appeal preferred by the petitioner, strictly in accordance with law and pass a reasoned order and communicate the same to the petitioner within a period of four weeks from the date of communication of a copy of this order.

The writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
