Mr. Pravas Bhattacharyya, along with Mr. Sandip Chakraborty, learned Advocates who usually appears on behalf of the State is requested to appear in this revisional application. Learned Public Prosecutor is requested to regularize the appointment of Mr. Pravas Bhattacharyya and Mr. Sandip Chakraborty.

The revisional application has been taken up for hearing. From the record it appears that the revisional application was filed in the year 2010 assailing the order dated 2nd February, 2010 passed by the learned Executive Magistrate, Canning Sub-Division at Canning- I in connection with M.P. Case being no. 53 of 2010 under Section 144(2) of the Code of Criminal Procedure. From the order impugned it is seen that order was passed under Section 144(2) of the Cr.P.C. which shall remain in force not more than two months from the date of order within the meaning of Section 144(4) of the Cr.P.C. unless it is further extended within the meaning of proviso Section 144(4) of the Cr.P.C. From the record, I do not find any such exercise of power under the proviso of Section 144(4) of the Cr.P.C.. So such order dated 2.2.2010 under Section 144(2) Cr.P.C. is not in force right now. Naturally, question of setting aside the order does not arise.

Thus the revisional application is disposed of accordingly.
