Petitioner submits he is not named in the FIR. He has been falsely implicated in the charge-sheet. He does not stand on the same footing with Bilal @ Mohammad Bilal whose prayer for anticipatory bail was rejected earlier. Accordingly, he prays for anticipatory bail.

Learned Advocates for the State opposes the prayer for anticipatory bail.

We have considered the materials on record. Petitioner was not named in the FIR. He has been implicated in the chargesheet. Unlike Bilal @ Mohammad Bilal no phone call or money trail is traceable to him.

Keeping in mind the extent of complicity of the petitioner in the crime and as investigation is complete, we are inclined to grant anticipatory bail to him.

Accordingly, we direct that in the event of arrest, the petitioner viz., Anis Khan be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. He shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
