This revisional application has been filed praying for expeditious disposal of an application under Section 12 of the Guardians & Wards Act, 1890 filed in connection with Act VIII Case No. 08 of 2019, pending before the learned District Judge, Hooghly. The application is for visitation rights of the father.

It is submitted by Mr. Ghosh, that the father has not been able to meet the child for a considerable period of time due to pendency of the said application.

Records reveal that the next date has been fixed on February 19, 2021.

Under such circumstances, the learned court below is directed to dispose of the application under Section 12 of the Guardians & Wards Act, 1890 mandatorily within a period of two months from the next date fixed upon affording an opportunity to the parties to contest the same.

This court has not gone into the merits of the claims of the petitioner. The learned court below shall proceed in accordance with law and independently.

Upon disposal of the pending application, learned court below is requested to dispose of the Act VIII case expeditiously.

The revisional application is disposed of. There shall be no order as to costs.

Petitioner is directed to serve a copy of the revisional application along with the server copy of this order upon the opposite party within seven days from date.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
