Special Court-cum-ADJ, 4th Court, Berhampore, Murshidabad and re-numbered as Special Case No. 6 of 2021.

The grievance of the petitioner is that the case was instituted in the year 2016 and charge has already been fixed in January, 2024. The ld. Special Court has been pleased to fix a schedule for examination of the witnesses on 4th and 5th of June, 2024.

Ld. Advocate submits that there are as many as eight witnesses in support of the prosecution. Having considered the time period which has lapsed and the petitioner is going to retire, the ld. Trial court is directed to fix at least one schedule consisting of three dates

on each and every month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

In case, any witness is absent, in that case, the inspector in charge of Hariharpara P.S.

would be communicated so that the witnesses may be made available on the date so fixed or, if any witness is absent, a report be furnished before the trial court with reasons. Ld. Public Prosecutor conducting the case would produce the materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders will cooperate with the ld. Trial court so that the tral is completed at the earliest.

With the aforesaid observations, CRR 629 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
