Mr. Ahmed, learned advocate for the State, has drawn the attention of the Court to the orders of the learned Executive Magistrate as well as the Revisional Order passed by the Learned Sessions Judge in Criminal Revision No.
11 of 2024.
Learned advocate for the private respondents disputes and denies the contentions raised by the petitioners.
Be that as it may, the main question which falls for consideration before this Court is as to whether a judicial order can be interfered with by invoking the powers of this court under Article 226 of the Constitution of India.
So far as the writ petition is concerned, the merits of the issues which have been canvassed by the petitioners cannot be interfered with as the judicial order, on the face of it, is glaring and has been decided on merits.
However, the petitioners would be at liberty to take steps as directed above.
With the aforesaid observations, WPA 3810 of 2025 is disposed of.
Pending application(s), if any, is also disposed of.
Needless to state that this court
has not entered into the merits of the case, but, has only decided on the maintainability of the writ petition.
