Biplab Murmu v. The State Of West Bengal
06.05.2025 Item No.19 Ct.No.34 rc.
C.R.M. (DB) 648 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Bamongola Police Station Case No. 106 of 2023 dated 16.07.2023 under Section 302/120B/34/201 of the Indian Penal Code.
And In Re :
Biplab Murmu ... Petitioner.
Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick ... for the Petitioner Mr. Anand Keshari Mr. Raju Mondal ... For the State Status report submitted by the State is taken on record.
The petitioner is in custody for about one year and ten months and prays for bail.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated due to political rivalry between him and the deceased who was his father. Learned counsel for the State opposes the prayer. I have considered the material on record. It appears that the deceased and the petitioner were in the same house at the time of the alleged incident and the house was locked from inside. Besides ligature mark on the body of the deceased, multiple abrasions have been detected in the post
mortem report. Though the petitioner claims that the victim committed suicide by hanging, there was blood on the floor of the room. Trial is in progress.
Considering the material on record as well as prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.
The application is disposed of.
Case Diary is returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
