State of West Bengal Mr. Mukteswar Maity Ms. Manika Sarkar ... for the petitioner Mr. Arijit Ganguly Mr. Sanjib Kumar Dan ... for the State The present revisional application has been preferred praying for expeditious disposal of Bhawanipore Police Station Case No.202 of 2016 corresponding to G.R Case No.1202 of 2016 pending before the Learned Additional Chief Judicial MagistrateII, Haldia, for offence punishable under Section 420 of the Indian Penal Code.

It is submitted that the present case was initiated on an application under Section 156(3) of the Cr.P.C and the Police Station case was registered on 22.07.2016 and the trial is not progressing.

Considering the slow progress of the case and the materials on record, which is being heard in presence of the learned counsel for the State who has submitted a status report wherein it is seen that investigation in this case has also not been completed unfortunately. Considering the present status of the case, it is clarified that if the charge sheet in the present case has not been submitted the investigating officer is directed to

complete the investigation and submit a report in final form within two months from this date, failing which the petitioner will be at liberty to approach the appropriate forum for relief.

In case the report in final form is submitted then the trial court shall proceed with the trial expeditiously and make all endeavour to dispose of the case within one year from the date of this order.

Let a copy of this order be sent to the trial court for necessary compliance.

Let a copy of this order be sent through the learned Public Prosecutor to the investigating authority for strict compliance.

Revisional application being CRR 541 of 2020 stands disposed of.

All connected application stands disposed of. Interim order, if any, stands vacated.

Learned counsel for the State to inform the status of this case to the concerned authority.
