Learned counsel for the WBSEDCL files a short statement on facts. It is indicated on instruction that, contrary to the allegation made by the petitioner, the WBSEDCL has already repaired the faulty electric meter of the petitioner.
Learned counsel for the petitioner prays for grant of instalments in depositing the dues in lieu of arrear electricity charges.
However, since Sections 126 and 127 of the Electricity Act 2003 do not permit partial deposit for restoration of electric connection, such prayer is turned down.
In view of the above developments, the basic premise of the writ petition, that is, the allegation that the WBSEDCL had failed to rectify the faulty meter of the petitioner, is belied.
Hence, WPA 3569 of 2022 is dismissed without any order as to costs.
The statement on facts filed in court today be kept on record.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
