Affidavit of service filed in Court is taken on record. Report filed by the State is also taken on record. Learned counsel appearing for the petitioner submits that the petitioner alleges inaction by the police in investigating Jiaganj PS Case No.294 dated 23.11.2022 under Sections 279//427/448/509/323/506 IPC.

Learned counsel appearing for the State relies on the report and submits that a charge-sheet being Jiaganj PS Case No.288 dated 30.11.2022 has been submitted in respect of the said FIR. In fact, a supplementary chargesheet being No.43 dated 03.03.2023 has also been submitted.

It is not clear whether the petitioner was duly intimated about the submission of charge-sheet and supplementary charge-sheet.

If the de facto complainant had not been intimated about filing of such report, he shall be at liberty to file a protest petition before the trial court.

With these observations, the writ petition is disposed of.

Urgent certified copies of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
