The instant appeal has been preferred against judgment and order dated 13.06.2001 passed by learned Metropolitan Magistrate, 9th Court, Calcutta in case no. C/932/97, acquitting the respondent No.2 herein from the accusation of having committed the offence under Section 138/141 of the Negotiable Instruments Act, 1881. The learned advocate for the petitioner has filed a copy of the 'Board Resolution' along with written instruction that his client does not wish to proceed with the instant appeal. A written instruction dated 06.10.2023 submitted before the court to that effect be kept on record.

Under the facts and circumstances, the instant appeal is dismissed for non-prosecution.

Copy of the order and lower court records be sent to the trial court for due compliance.
