Paramanick ...... for the State The application for anticipatory bail under section 438 Cr.P.C has been filed apprehending arrest in connection with Saltora P.S Case no. 63 of 2020 dated 27.9.2020 under sections 143/144/147/148/447/324/326/307/302/506/120B of the IPC. Anticipatory bail has been sought on the ground that the dispute which resulted in the offence against the petitioner was primarily civil in nature.

Counsel for the State produces the case diary and opposes the prayer for anticipatory bail.

Having considered the materials in the case diary and having heard the arguments of the parties this court notices that the allegation against the petitioner is that he was present at the place of occurrence and had in fact assaulted the victim which ultimately resulted in death.

In view of the gravity of the offence and the complicity of the petitioner, we are not inclined to entertain the application for anticipatory bail.

Accordingly, CRM 1685 of 2021 stands rejected. (Biswajit Basu, J.) (Rajasekhar Mantha, J.)
