CESC Limited and others (Via Video Conference) Mr. Smarajit Roychowdhury .... for the petitioner Mr. Suman Ghosh .... for the CESC Limited Mr. Rajarshi Basu, Mr. Parikshit Goswami .... for the State Learned counsel for the petitioner submits that despite having applied for a new electricity connection in the petitioner's name and having complied with initial formalities, the CESC Limited is unable to give such connection to the petitioner, apparently due to resistance being put up by the private respondent no.4.

Despite service, none appears for the private respondent, although the petitioner and the respondent nos.1 and 2 are represented through counsel.

Learned counsel appearing for the CESC Limited contends that the respondent no.4 is apparently a promoter, who is creating obstruction to the petitioner, despite the petitioner having applied legitimately for an electricity connection, for which the connection cannot be given.

In view of the facts and circumstances as narrated above, WPA No.3582 of 2022 is disposed of by directing the CESC Limited to give a new electricity connection to the petitioner from the existing meter board position at the premises as per the application of the petitioner, subject to compliance of all formalities by the petitioner.

The CESC personnel, if obstructed by the respondent no.4 and/or or his men and agents at the time of giving such connection, will be at liberty to approach the respondent no.3, that is, the Officer-inCharge of the Sankrile Police Station, to provide adequate police assistance.

If so approached, the respondent no.3 shall act on the communication of the learned Advocates for the parties, coupled with server copies of this order, and provide adequate police assistance to the CESC personnel for the limited purpose of giving new electricity connection to the petitioner, at the petitioner's own cost.

It is made clear that in the event the CESC personnel face any hindrance, for example, a padlock etc., in getting access to the existing meter board position at the premises-in-question, it will be open to the police personnel to break open such padlock or remove such hindrance, also for the limited purpose of enabling the CESC personnel to give such connection to the petitioner.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
