1. Learned Advocate for the petitioner seeks leave to withdraw the present application and file appropriate application in accordance with law on self same cause of action.

2. As prayed for CO 595 of 2026 is dismissed as withdrawn with liberty to the petitioner file appropriate application challenging the order dated July 19, 2025 passed by the learned Additional Chief Judicial Magistrate, Berhampur, Murshidabad in M R Case No. 1091 of 2024, in accordance with law.

3. The petitioner shall be at liberty to take back the certified copy of the order impugned upon furnishing a photostat copy thereof duly counter signed by the learned advocate on record for the petitioner.
