Kausik (Allowed) CRM (M) 485 of 2026 In Re: An Application for Bail under Section 483 of the BharatiyaNagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1143 of 2023 dated 23.08.2023 under Sections 395/397/412 of the Indian Penal Code. The State does not dispute that similarly situated accused persons were granted bail by this Court on 10.02.2026 in CRM(M) 2441 of 2025.

In view of the foregoing, and on the ground of parity, the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand Only) each, along with two sureties of the like amount each, one of whom must be a local, to the satisfaction of the Learned Additional Sessions Judge, Fast Track, 3rd Court (I/C), Malda. It is further directed that the petitioners shall appear before the trial Court on every date of hearing until further orders and shall not intimidate any witnesses or tamper with

evidence in any manner. Failure on the part of the petitioners to comply with the aforesaid conditions shall entitle the trial Court to cancel the bail granted to the petitioners in accordance with law, without any further reference to this Court. Accordingly, CRM (M) 485 of 2026 stands allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
