Commercial quantity of contraband was recovered from the petitioner. In view of the restriction in Section 37 of the NDPS Act, the petitioner's prayer for bail is rejected. The petitioner says that he is in custody for about four years and four months. There is no significant progress in the trial.

A report has been filed by the Superintendent of Police, Bongaon Police District in terms of this Court's order dated April 22, 2021. Let the report be kept on record.

It appears from the report that trial is now progressing. Learned State Counsel apprises us that the next date for recording of evidence has been fixed on September 10, 2021. In view of the very lengthy detention of the petitioner, we request the learned Trial Court to expedite the trial to the extent possible and bring the same to its logical conclusion as soon as the business of the Court may permit and preferably within a period of one year from date without granting any unnecessary adjournment to either of the parties. The prayer for bail stands rejected.
