The petitioner/State Bank of India is aggrieved by the fact that in spite of District Magistrate, Burdwan having passed direction, there has been non-cooperation on the part of the police authorities.

Learned advocate appearing for the State submits that the order of the District Magistrate was passed in the year 2016 and there was information by the Superintendent of Police, Purba Bardhaman that Kanksa Police Station falls within the jurisdiction of Asansol-Durgapur Police Commissionerate.

Since the order of the District Magistrate is still subsisting, the petitioners would approach the Deputy Commissioner in-charge of Kanksa Police Station of Asansol-Durgapur Police Commissionerate who would facilitate the directions passed by the District Magistrate, Burdwan on 30.11.2016.

The police authorities would render cooperation and assistance to the petitioners since the petitioner happens to be a nationalised bank. In case the police authorities are reluctant to act, there must be specific information with the police authorities as to whether such order which has been relied upon by the District Magistrate in passing the direction has been subsequently modified or varied by a court of law or tribunal. With the aforesaid observations, the writ petition being WPA 3858 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
