Dr. Sayed Asgar Nawaz Mr. Siva Prasad Ghose ... for the petitioners The principal grievance of the petitioner is that the misc. case under Section 47 of the Code of Civil Procedure being Misc. Case No.100 of 2018 is still pending.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, the petitioners shall be obliged to forward the copy of this application as well as the order of this court upon the opposite party and the learned advocate appearing for the opposite party in the learned trial court.

From the orders appended to the civil revisional application, it appears that by an order dated 14th January, 2025, the evidence of PWs in the said misc. case has been fixed on 20th March, 2025.

In view thereof, CO 574 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), 5th Court, Howrah, to take up hearing of the Misc. Case No.100 of 2018 on the next date fixed i.e. 20th March, 2025 and make an endeavour to

dispose of the same expeditiously preferably by the end of September without granting unnecessary adjournments.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon compliance of all necessary formalities.
