1. Let affidavit-of-service, as filed in Court, be kept on record.

2. Petitioner is an Assistant Professor, rendering services in the Zoology Department of the Garhbeta College. He stays at Jalpaiguri with his family and has to undertake 1200 kilometers to and fro from his residence to his college. The petitioner is himself not well and has an ailing mother and two children at Jalpaiguri. He has applied for transfer to a college close to his residence at Jalpaiguri, two of which do not have any vacancy. The Women P.D. College at Jalpaiguri has a vacancy in the post of Assistant Professor in Zoology. The petitioner has applied

for transfer of own seeking and prima facie does not seem to be disentitled by the parameters or conditions set forth in the Notification of the Government of West Bengal, Department of Higher Education, Science & Technology and Biotechnology, (integrated Law Cell), Bikash Bhaban, Salt Lake, Kolkata - 700 091, dated November 1, 2017.

3. The petitioner had, thus, applied to the respondent no. 3 on several occasions since 2022 and lastly on November 14, 2025, to consider his prayer for transfer. The representation of the petitioner has not been considered in any manner by the respondent no. 3.

4. Respondent no. 3 is directed to consider the representation of the petitioner by March 31, 2026, upon giving hearing to the petitioner with adequate prior notice.

5. The decision on the representation will be communicated by the respondent no. 3 to the petitioner as well as respondent no. 4 by April 10, 2026.

6. With these aforestated directions, the writ petition is disposed of.

7. There shall, however, be no order as to costs.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
