Heard the parties.

Affidavit of service filed in Court be taken on record. The grievance of the petitioner is directed against the refusal of the respondent distribution company to provide a permanent electricity connection at the subject premises.

The respondent distribution company is represented and submits that they have no objection in giving such permanent electricity connection subject to compliance with all necessary formalities.

Private respondents are represented and submit that electricity connection should not be taken from the land belonging to the petitioner.

It is further submitted on behalf of the private respondents that there is an alternative option available

for providing such permanent electricity connection to the subject premises of the petitioner.

In view of the factual disputes which arise for consideration, I direct the District Magistrate of the concerned locality to consider and dispose of the grievance of the petitioner for providing a permanent electricity connection to the premises of the petitioner. Liberty is granted to the petitioner to file a representation before the concerned District Magistrate within a period of two weeks from date after providing copies of the same to the private respondents and the distribution company.

The District Magistrate is directed to consider and dispose of the representation of the petitioner within a period of eight weeks from date after giving a right of hearing to all the affected parties.

It is needless to mention that all points are left open to be decided by the District Magistrate without being influenced by any of the observations on the merits of this case.

With the aforesaid directions, WPA 4427 of 2021 is disposed of.

However, there will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
