Versus

Sikha Sarkar sg Ct. 8 CAN 2 of 2008 (old CAN 10827 of 2008) is the joint application filed by the parties for extension of the interim order of unconditional stay in Title Execution Case No. 7 of 2007 arising out of TS 92 of 2001 for the period of six months from the date of the order.

The application was filed in view of the fact that the parties had agreed to settle their dispute and withdrawal of cases pending before the District Consumer Foram, Alipore. The application was filed on 18th December, 2008. We do not find any reflection of the said application in any of the orders available on record. The parties are not represented. It appears that the parties may have settled their dispute in the meantime. Under such circumstances, we dismiss the appeal. In view of the dismissal of the appeal, the connected application is, accordingly, dismissed.

All interim orders, if any, stand vacated.

LCR, forwarded to this Court in connection with the Title Suit 92 of 2007, may be returned to the learned Civil Judge (Senior Division), 3rd Court, Alipore.
