The petitioner prays for implementation of the order dated 24th November, 2021 passed by the Special Officer, Building.

An accommodation has been sought for on behalf of the learned advocate appearing for the private respondent.

The learned advocate representing the Kolkata Municipal Corporation admits that order was passed on 24th November, 2021 but the same is yet to be implemented.

When an order is passed by the authority, steps ought to have been taken for implementing the same instead of merely retaining the said order in the file. In the present case, an order of demolition has been passed way back in November, 2021 but the same is yet to be implemented.

The instant writ petition is, accordingly, disposed of by directing the Executive Engineer, Borough XVI of the Kolkata Municipal Corporation to take immediate steps for implementing the order dated 24th November, 2021

passed in respect of the premises No. 1A Thakurpukur Road, Ward No. 125, Borough XVI positively within a period of twelve weeks from the date of communication of this order provided the same is not set aside/modified/varied by any Court of competent jurisdiction.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
