The petitioner is an Assistant Teacher in Physical Education at Mahammadpur Deshpran Vidyapith (H.S.), District : Purba Medinpur, he had applied for general transfer under the Utsashree Portal, the said application has been rejected as the Chief Medical Officer opined that 'the disease of the patient is not serious' .

There is no scope for re-assessment of the opinion of the Chief Medical Officer in exercise of the power under Article 226 of the Constitution of India.

W.P.A. 3769 of 2023 is therefore dismissed without any order as to costs.
