For the Respondent Nos. 5-6 On prayer of the petitioner, liberty is granted to implead the Secretary, Regional Transport Authority, South 24 Parganas as respondent No. 7 in the writ petition. The cause title of the writ petition be amended accordingly.

Since the 7th respondent is already represented, service of notice upon the said respondents is dispensed with. Heard learned counsels for the parties.

It is contended on behalf of the petitioner that the petitioner is the owner of an auto rickshaw which is covered by a contract carriage permit valid till 28th August, 2026. Since the vehicle has completed the age of 15 years, the petitioner seeks to apply for replacement of the said vehicle by a new auto rickshaw. In view of the above, the writ petition is disposed of with liberty to the petitioner to submit an application for replacement of his old vehicle by a new one before the Secretary, Regional Transport Authority, South 24 Parganas being the 7th respondent herein within two weeks from date. The 7th respondent is directed to consider and dispose of the application within six weeks from the

date of receipt thereof upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law, subject to the petitioner complying with all necessary formalities in this regard.

The decision taken by the authority shall be communicated to the petitioner within a week thereof.

The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
