For the State The petitioners contend that they are operators in route No. 26 from Champadanga to Kolkata Station on the basis of valid permits issued in their favour by the Regional Transport Authority, Hooghly. The petitioners learnt that the State Transport Authority, West Bengal is introducing bus services from Gazarmore to Karunamoyee which covers major part of route no. 26. According to the petitioners, the introduction of the new route shall prejudicially affect the business of the petitioners. The petitioners submitted a complaint in this regard before the concerned authority on 21st December, 2022 which is yet to be considered. The petitioners pray for a direction upon the authority to consider the complaint submitted by them at the earliest.

It is submitted on behalf of the respondents that the 4th respondent be directed to consider the complaint in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the complaint filed by the petitioners dated 21st December, 2022 within six weeks from the date of communication of this order after affording reasonable opportunity of hearing to all the stake holders including the petitioners, in accordance with law.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
