Petitioner is aggrieved by the fact that the private respondent is trying to raise construction over the land allotted to the petitioner and others. State has submitted a report. Report reflects Title Suit No. 22 of 2024 is pending before the learned Civil Judge, 3rd Court (Junior Division), Baruipur wherein an order of injunction has been passed restraining from changing the nature and character of the property.

Police authorities have already taken steps, so that no further construction has been carried out. Further the police authorities have registered Maipith Coastal PS Case No.

17/24 dated 07.02.2024 against more than 12 accused persons. Having considered that the police authorities have taken steps, in case further

construction work is pursued, petitioner will bring the same to the notice of the learned Civil Judge, 3rd Court (Junior Division), Baruipur who would pass necessary directions upon the police authorities to implement its order and in case of any violation hold the police authorities to be responsible for the same. It is directed that police authorities would respect, obey and implement the order of the learned Civil Judge, 3rd Court (Junior Division), Baruipur. Police authorities are further directed that over the said issue there should not be any breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations WPA 3851 of 2024 is disposed of.

Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
