It is submitted that the District Magistrate has wrongfully dealt with the representation filed by the petitioner and ought to have granted the permission for an electricity connection and the consequential relief. By an order dated 13.12.2022 this Court had, inter alia, directed as follows:

"Mr. Sougata Mitra, Special Officer, is directed to oversee that an electric connection is available at the premises of the petitioner in accordance with law. For such exercise, the Special Officer shall be paid a sum of Rs.5,000/- by the petitioner prior to taking any steps for installation of the electricity connection to the premises of the petitioner." It is submitted that the petitioner was unable to arrange necessary funds to pay the Special Officer and steps have now been taken to make such payment.

Mr. Shukla, appearing on behalf of the respondent Corporation unequivocally admits that if payment and necessary permissions are obtained, the electricity connection would be granted to the petitioner. Under such circumstances, the time for the Special Officer to oversee the electricity connection available to the subject premise is extended by a period of 3 months from date.

Upon payment of costs of Rs.5,000/-, the Special Officer will ensure the installation of an electric connection to the premise of the petitioner. The respondent authorities are directed to give all assistance in accordance with law in obtaining such necessary connection.

Nothing survives in this application.

With these observations, CPAN 178 of 2022 stand disposed of.

Liberty to apply to the petitioner.
