Mr. Debnath Mahata ...for the petitioners The petitioner has filed this application under Article 227 of the Constitution of India challenging the order being No.44 dated January 3, 2025 passed by the learned Civil Judge (Jr. Divn.), 2nd Court, Alipore in Title Suit No.236 of 2018.

After some argument Mr. Roy, learned Senior advocate appearing for the petitioner submits that a direction may be passed upon the learned Trial Judge to dispose of the suit expeditiously. He further submits that the issues have already been framed and the suit has been posted for evidence.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocate representing him before the learned Trial Judge.

Considering the fact that the suit is for eviction of a licensee filed in the year 2018 and the suit, as submitted by Mr. Roy, is otherwise ready for hearing, the learned Civil Judge (Jr. Divn.), 2nd Court, Alipore is requested to dispose of the Title Suit No.236 of 2018 as expeditiously as possible preferably by the end of December, 2025 without granting any unnecessary adjournments to either of the parties.

With the above observations CO 579 of 2025 is disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
