Sajal Sen v. State Of West Bengal & ORS
26.8.2021 ks WPA 2911 of 2020 sl. 133 Sajal Sen Vs The State of West Bengal & Ors.
Mr. Promit Majumder ... For the Petitioner.
Mr. A. Ray, Ld. GP., Mr. Soumitra Mukherjee, Mr. N. Chatterjee ... For the State.
Heard learned Advocates appearing for the parties. This writ petition has been filed on a very short and limited ground of non-appearance of the learned Advocate representing the petitioner due to agitation of the Lawyers on that date in the impugned proceedings before the Fast Track Revisional Authority, Bench No.III on the date of hearing on 24th October, 2019 when the impugned ex parte order was passed.
In the interest of justice, petitioner is given one opportunity of hearing before the aforesaid Revisional Authority by setting aside the ex parte impugned order dated 24th October, 2019 solely on the ground that on the date of the impugned order, the petitioner could not represent his case due to the reason beyond his control.
The Fast Track Revisional Authority concerned is directed to consider afresh the case of the petitioner strictly on merits within four weeks from the date of the communication of this order by providing
opportunity of hearing to the petitioner or his authorised representative.
It is recorded that this court has not gone into the merits of the case and the authority concerned while deciding the case of the petitioner will act strictly in accordance with law.
WPA 2911 of 2020 is disposed of.
