Learned Advocate for the petitioner prays for compassionate appointment on the ground that his father expired in 2021 while serving as a Mohammedan Marriage Registrar (MMR).

Mr. Basu Mallick, learned Additional Government Pleader submits that the petitioner cannot be considered for compassionate appointment. The application should have been made within six months from the date of death of the father. Moreover, the petitioner was required to fulfil the eligibility criteria, which the petitioner did not.

It appears that the petitioner was communicated a rejection order, but the order does not provide the details. The reasons as to why the petitioner was not found to have the requisite

qualifications and why the application was found to be belated, must be provided.

Under such circumstances, the writ petition is disposed of with a direction upon the Inspector General of Registration and Commissioner of Stamp Revenue, West Bengal, to treat the writ petition as a representation of the petitioner and dispose of the same by passing a reasoned order and inform the same to the petitioner, upon perusal of the records filed by the petitioner and upon considering the petitioner's qualification and the requirement of law.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
