(Via Video Conference) Mr. Arka Bhattacharya, Mr. Ayan Mitra ...for the petitioner Mr. Susanta Pal, Mr. Ananda Dulal Sarkar ...for the State The petitioner was deployed as a Civic Police Volunteer by the respondent no. 3 under the direct control and authority of the respondent no. 2 pursuant to G.O. No. 752 dated February 28, 2013. The G.O. No. 752 dated February 28, 2013 lapsed in June, 2014 whereafter the respondent no. 1 issued G.O. No. 1940 dated July 14, 2014 wherein it was decided to continue such deployment for a further period of 6 months for only the enrolled Civic Police Volunteers.

The petitioner submits that he approached to the respondent no. 3 and thereafter the respondent no. 2 for further deployment but was informed that they won't be engaged despite G.O. No. 1940 dated July 14, 2014.

The petitioner challenged the disengagement in 2013 for the first time by representation dated 10.04.2019 and has affirmed the instant writ application in February 8, 2021.

This Court notes that more than 7 years have elapsed since after disengagement of the petitioner. The writ petition is hopelessly barred for delay and latches. No relief can be granted to the petitioner.

Hence, the writ petition must fail and is hereby dismissed.

There shall be no order as to costs.
