Report submitted by Ms. Faria Hossain, learned advocate appearing for the State be kept with the record. The complainant is aggrieved by the factum of ST-3(9) 2019 arising out of K.L.C. Police Station Case No.37 of 2018 regarding its progress as after five years none of the witnesses have been examined and the prosecution has relied upon 21 witnesses to prove its case.

It has been informed that the next date is fixed on 28th July, 2023 for deposition of the complainant. Learned trial court is directed to fix a schedule consisting of three dates and to fix such schedule at least once in every two months so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. If any of the accused persons do not cooperate with the trial of the case then the learned trial court will be at liberty to

impose conditions in respect of the bail so granted and/or interfere with the order of bail so passed. No unnecessary adjournment should be granted to either of the parties and if any witness is reluctant to appear before the court, immediate notice be issued through the Inspector-in-Charge of the concerned Police Station so that the appearance of the witness on the date so fixed is ensured. All efforts be taken to conclude the trial at the earliest. With the aforesaid observations, CRR 641 of 2022 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
