It is not in dispute that the petitioner has been absconding for a considerable period of time and has been declared proclaimed offender under Section 82 of the Code of Criminal Procedure. It is also submitted on behalf of the State that trial has proceeded after being split up due to abscondence of the petitioner.

In view of the same, the present application under Section 438 of the Code of Criminal Procedure is not maintainable and is, therefore, dismissed.
