The petitioner claims that she applied for the post of Anganwadi Worker (AWW). A panel was prepared in 2012 for filling up the vacancies to the post of AWW. The petitioner's grievance is that despite a vacancy being present, the petitioner was not given any appointment.

By an order dated February 16, 2015, passed by a Coordinate Bench of this Hon'ble Court the State respondents were directed to ensure that the vacant posts are filled up as expeditiously as possible and preferably within 3 months from date. It was observed that the petitioner could apply to the recruitment process subject to the fulfilment of the eligibility criteria.

Zeeshanuz Zaman, learned counsel appearing on behalf of the petitioner submits that despite vacancy being present, the petitioner has not been engaged in the post of AWW. The petitioner's representation dated January 19, 2023 has not been considered till date.

Mr. Prasad, learned counsel appearing on behalf of the State respondents submits that there are orders passed by the Hon'ble Division Bench in 2014 whereby the entire panel has been stayed. He further submits that the said interim orders have not been vacated.

Considering the submissions of the parties and the materials placed on record, this Court directs the representation dated January 19, 2023 to be considered by the Sub-Divisional Officer, Chanchal/respondent no.7 within 10 weeks from date taking into account the order dated February 16, 2015 passed by the Coordinate Bench and also the existing orders of the Hon'ble Division Bench. The said representation is to be disposed of by a reasoned order and the same be communicated to the petitioner within 2 weeks of passing thereof. With the directions aforesaid, WPA 3834 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the said writ petition, the allegations contained therein are deemed not to have been admitted by the respondents.
