Heard learned counsels for the parties.
By an order passed on September 13, 2022 in WPA 19923 of 2022 this Court directed the Secretary, Regional Transport Authority, Paschim Burdwan, being the 4th respondent therein to receive/accept the application filed by the petitioner along with requisite fees for issuance of fresh permit within a stipulated time frame. Learned counsel for the petitioner submits that the said order has not been complied with by the authority till date. The petitioner submitted a further representation in this regard on 24th January, 2024 which is also pending.
Learned counsel for the respondents submits, on instructions, that the representation submitted by the petitioner has been considered by the authority and permit issued in favour of the petitioner.
In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of
the representation submitted by the petitioner dated 24th January, 2024, if not already considered, in terms of the order passed by this Court on September 13, 2022 in WPA 19923 of 2022 within one month from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the aforesaid directions the writ petition is disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
