Though previously it was submitted on behalf of the petitioner that this is a case relating to transfer application on medical ground but during course of hearing today on behalf of the respondents it has been disputed that petitioner made transfer application on medical ground in reference to the documents which are at pages 37 and 44 of the writ petition.

In consideration of the submission made on behalf of the respondent authorities that petitioner has not made application for transfer on medical ground query is posed to the learned advocate representing the petitioner to

demonstrate before this Court that application has been made by the petitioner seeking transfer on medical ground. At this stage the learned advocate representing the petitioner prays for leave to withdraw this writ petition with liberty to take steps in accordance with law for petitioner's transfer on medical ground.

Having considered the submissions made on behalf of the petitioner the writ petition stands dismissed as withdrawn with liberty to take steps for transfer of the petitioner in accordance with law.

However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
