Mr. Arka Bhattacharya ..For the Petitioner Mr. Somnath Naskar ...For the State The petitioner was engaged as a Civic Volunteer in or around October 2013. The engagement of the petitioner has been extended from time to time. The petitioner has been disengaged from sometime in January 2019. Petitioner has made several representations before the Superintendent of Police, Purba Bardhaman and also the Officer-in-Charge, Ausgram Police Station for re-engagement but such prayer of the petitioner has not been acceded to.
Mr. Bhattacharya, learned counsel appearing on behalf of the petitioner submits that the petitioner's representation dated March 2, 2021 has not been considered till date. On March 20, 2023, Mr. Mukherjee, learned Additional Government Pleader was directed to take necessary instructions in the matter. Written instructions are handed over on behalf of the State authorities today by Mr. Naskar,
learned Advocate. Such instructions dated April 2, 2023 are retained with the records.
It appears that three criminal cases are pending against the petitioner. Ausgram P.S. Case Nos. 169/13, 182/13 and 223/14 are pending against the petitioner. Under the Rules/Guidelines pertaining to Civic Police Volunteers published in the Howrah Police Gazette dated October 1, 2011, it appears that involvement in any criminal case may lead to termination of voluntary service of the petitioner. In the light of the facts stated hereinabove, this Court finds no infirmity in termination of the petitioner's service as a Civic Police Volunteer and refusal to accept the prayer of reengagement. Accordingly, W.P.A. 3835 of 2023 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
